Conditions

1 Scope
1.1 All contracts with the company Bolero Drink Shop / Sport Dreams GmbH are exclusively subject to these terms and conditions. Deviations in this regard are hereby expressly contradicted. Regulations other than those laid down below only become effective with the express written consent of Bolero Drink Shop / Sport Dreams GmbH. The terms and conditions apply to all products and services for which a contract is concluded with Bolero Drink Shop / Sport Dreams GmbH.

1.2 The contractual partner agrees to the inclusion of the terms and conditions in the contract to be concluded with Bolero Drink Shop / Sport Dreams GmbH. The terms and conditions of the company Bolero Drink Shop / Sport Dreams GmbH also apply to future business relationships, as far as legal transactions of a related kind are concerned.

1.3 Different or deviating conditions from customers are not recognized unless Bolero Drink Shop / Sport Dreams GmbH has expressly agreed to them in writing.

1.4 The binding version of the terms and conditions of the company Bolero Drink Shop / Sport Dreams GmbH is published at www.bolero-drink.de.

The offers published on the website www.bolero-drink.de are non-binding unless a binding written declaration, offer or written assurance is expressly given to the customer. The prices include VAT. (except dealers with access code)

3. Contract/Purchase
A contract between the customer and the company Bolero Drink Shop / Sport Dreams GmbH is based on the customer's order (execution via the order button in the web shop, mail order or SMS order). The immediate confirmation of receipt of the order to the customer is either automated or sent by e-mail and does not mean that the goods are available. A delivery guarantee is therefore not automatically given. The purchase price must be paid immediately after the order is placed.

4. Proof of Age
By placing the order, the customer confirms that they are of legal age.

5. Deviations
It is always possible that there may be slight deviations from the published product descriptions or images.

6. Delivery
The delivery time for shipping in Germany is usually a maximum of 4-5 working days. A delivery time of 8-10 working days must be expected for shipping outside of Germany (see Delivery Conditions section). Due to greater demand, the delivery time can never be guaranteed, especially since Bolero Drink Shop / Sport Dreams GmbH is dependent on timely delivery to itself. Of course, we always try to meet the specified delivery times. If the company Bolero Drink Shop / Sport Dreams GmbH is not supplied by suppliers or producers within a period of time, it has the right to withdraw from the contract. In the event of such a withdrawal, the customer has no right to compensation. Invoice amounts paid in advance will be refunded immediately by Bolero Drink Shop / Sport Dreams GmbH. 
The customer is also not entitled to compensation if the delivery does not reach the customer within the specified period due to force majeure. Such events include, for example, fire, floods, strikes, operational disruptions or similar events for which Bolero Drink Shop / Sport Dreams GmbH is not responsible. Bolero Drink Shop / Sport Dreams GmbH is willing to inform customers immediately in such cases.

In the case of multiple orders, Bolero Drink Shop / Sport Dreams GmbH has the right to make partial deliveries if the customer has not expressly requested otherwise in writing. If Bolero Drink Shop / Sport Dreams GmbH makes use of this right, only the delivery costs for the total delivery will be charged.

 

7. Terms of Delivery/Shipping

7.1 Basics
The shipping costs/postage costs/packaging costs are borne by the customer. The goods are delivered by the provider within 4-5 working days in Germany and within 8-10 days for Switzerland, Liechtenstein, Austria, Italy, France, Monaco, Luxembourg, Belgium, Holland, Denmark and Sweden. The shipments are made by Deutsche Post, DHL or Hermes as well as Swiss Post. If Bolero Drink Shop / Sport Dreams GmbH does not have an item in stock, the procurement time is between 15-20 working days. The customer will be informed immediately as soon as the goods are back in stock.
In particular, Bolero Drink Shop / Sport Dreams GmbH cannot be held responsible for non-delivery or late delivery due to an incorrect or incomplete address or due to the fault of Deutsche Post, DHL or Hermes, and no claims for damages can be asserted. Deliveries via letter post are always delivered without outer packaging.
The delivery conditions section is part of the general terms and conditions and is deemed to have been accepted and read with the confirmation.

7.2 Costs

51 - 250 g = € 1.80 (Deutsche Post - letter)

251g - 2kg = € 4.49 (DHL)

up to 50 g = € 3.25 (Deutsche Post - letter)

51 - 250 g = € 3.80 (Deutsche Post - letter)

251g - 2kg = € 4.99 (DHL)

2.001 to 5 kg = € 5.99 (DHL)
5.001 to 10 kg = € 8.50 (DHL)

from 10,001 kg = € 16.50 (DHL)

7.2.3 Shipping/packaging via DHL International to Switzerland, Lichtenstein, Austria, Italy, France, Monaco, Luxembourg, Holland, Belgium, Denmark and Sweden

The company Bolero Drink Shop is also allowed to consider other service providers for shipping, the prices are in no case higher than stated here or in the delivery conditions, this is never a disadvantage for the customer.

 

8. Terms of Payment
The products from Bolero Drink Shop / Sport Dreams GmbH are only delivered with advance payment (Paypal, Klarna, VISA, Mastercard, Stripe   and advance payment by bank transfer). If payment in advance is not made within 5 working days after the order, Bolero Drink Shop / Sport Dreams GmbH can cancel the order.
In addition, PayPal charges a purchase value of less than EUR 15.00 of EUR cents 50, otherwise PayPal cannot cover the costs.

 

9. Consequences of revocation/right of revocation
The right of withdrawal section is part of the general terms and conditions and is deemed to have been accepted and read with the confirmation.

10. Retention of Title
The goods remain the property of Bolero Drink Shop / Sport Dreams GmbH until full payment has been made. The Bolero Drink Shop / Sport Dreams GmbH is therefore entitled to collect the goods from the customer at any time, even without prior notification.

11. Liability

Bolero Drink Shop / Sport Dreams GmbH undertakes to provide our services with due care in accordance with the General Terms and Conditions and the other contractual provisions. Claims for damages due to impossibility of performance, breach of contract, culpa in contrahendo and tortious acts are completely excluded, unless intentional or grossly negligent action is involved. Liability for indirect damage and consequential damage resulting from use, faulty performance or a drop in performance is also completely excluded.

12. External Links and Content
Bolero Drink Shop / Sport Dreams GmbH assumes no responsibility or liability for the content or offers of external links on our website.

13. Privacy
Your data will only be stored and used for internal purposes and for order processing. Under no circumstances will we pass on your data to third parties.

14. Modification of Terms and Conditions
The terms and conditions can be changed at any time. At the time of the contract, the general terms and conditions published on www.sportdreams.ch apply. The customer is obliged to inform himself regularly about given changes of the AGB's.

15.Copyright
We would like to point out that all content, logos, images, designations and brand names belong either to the respective company or to Sport Dreams GmbH. Distribution and any kind of exploitation outside the limits of copyright require the written consent of the respective companies. Downloads and copies of this site are only permitted for private use and under no circumstances for commercial use. Violations will result in criminal prosecution.

16. Jurisdiction and Applicable Law
For all disputes with the Bolero Shop Drink / Sport Dreams GmbH, the place of jurisdiction is Konstanz - subject to different mandatory places of jurisdiction in the EU - (This also applies to Switzerland, Liechtenstein, Austria, France, Luxembourg, Belgium, Holland, Denmark, Norway and Sweden ( without application of the Vienna Sales Convention)) 
The applicable law is only German and EU law, foreign law is completely excluded.
The provisions of the UN Sales Convention expressly do not apply.
